READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS

1.In exchange for participation in the phlebotomy training program, including but not limited to blood draws, venipuncture, and IV training (the “Program”), organized by Oquirrh Mountain Phlebotomy School LLC (OMPS) and its contracted instructors, the Student agrees to the following:

2.By signing this enrollment agreement the student agrees to the terms and conditions of this website www.oqmps.com.  to observe and obey all posted rules and warnings and to follow all written and verbal instructions provided by Oquirrh Mountain Phlebotomy School LLC (OMPS INC), its instructors, employees, or representatives. The Student acknowledges that participation in phlebotomy training involves inherent risks, including but not limited to needle sticks, exposure to bloodborne pathogens, bruising, fainting, injury, and physical interaction with other individuals. The Student voluntarily assumes all risks, whether known or unknown, associated with participation in the Program.

3.The Student hereby releases, waives, and discharges Oquirrh Mountain Phlebotomy School LLC (OMPS INC), its owners, officers, instructors (including contracted instructors), employees, and agents from any and all liability for injury, illness, loss, or damage arising out of or related to venipuncture(Blood draws or IV) participation in the Program, whether caused by negligence or otherwise, to the fullest extent permitted by law. The Student further agrees to indemnify, defend, and hold harmless Oquirrh Mountain Phlebotomy School LLC (OMPS INC) and its instructors from any and all claims, damages, liabilities, costs, or expenses, including attorney’s fees, arising from the Student’s participation in the Program, the Student’s actions or omissions, or any third-party claims related to the Student.

4.The Student agrees to be financially responsible for any damage to equipment, supplies, or facilities caused by the Student’s negligent, reckless, or intentional actions. The Student understands that they have the right to cancel this Agreement within three (3) business days of signing by submitting written notice by email to office@oqmps.com If canceled within this period, all monies paid will be refunded. After this three (3) business day period, the deposit or the full amount whichever amount was paid on the website www.oqmps.com becomes non-refundable and all payments are subject to Oquirrh Mountain Phlebotomy School LLC (OMPS INC refund policies.

5.The Student acknowledges and agrees that once they attend any portion of the Program, no refunds will be issued for any reason, including dissatisfaction with the course, instructor, scheduling, or content. The Student further understands that this is a condensed training program and that course content may vary depending on time constraints, class size, student participation, and instructor discretion. Oquirrh Mountain Phlebotomy School LLC (OMPS INC) does not guarantee that every topic, skill, or item listed in any syllabus, outline, or promotional material will be fully covered or covered in equal depth. The Student agrees that partial coverage of course material does not constitute a breach of contract and does not entitle the Student to any refund, dispute, or claim.

6.The Student acknowledges that instructors, including contracted instructors, have full discretion over teaching methods, pace of instruction, and allocation of time to specific topics. Variations in teaching style, instructional delivery, or perceived omissions of content shall not constitute grounds for refund, complaint, or legal action.

7.The Student understands that completion of the Program does not guarantee certification or employment and that certification eligibility depends on individual performance and successful completion of any required examinations, including those offered through www.npct.org or www.ivexam.com and www.ekgexam.com. The Student further agrees that their success in the program depends on their own participation, effort, and skill development, and that failure to attend or complete required components does not entitle them to a refund.

8.Any legal or equitable claim arising out of participation in the program shall be governed by the laws of the state in which the course is conducted. The Student agrees that any dispute, claim, or controversy arising out of or relating to this Agreement shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, and judgment on the award may be entered in any court of competent jurisdiction.

9.The Student acknowledges that they have read this Agreement in its entirety, fully understand its terms, have had the opportunity to seek independent legal counsel, and are signing voluntarily without any pressure or duress. The Student further agrees that this Agreement represents the entire understanding between the parties and supersedes any prior discussions, representations, or agreements. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The total for the phlebotomy class is $595 and must be paid the first day of their scheduled class. The total for the IV class is $398.00. The total for EKG class is $295 and must be paid the first day of their scheduled class. Anyone finishing their payment can do so with card, cash, or Money order (No personal checks).

Phlebotomy Occupational Objective: The graduate will be able to acquire a position in the field of phlebotomy performing blood specimen collection.
IV Occupational Objective: The graduate will be able to acquire a position performing IV’s as part of their job description.
Admission Requirements: You must have your High school diploma or a General Education Development certificate and be 18 or older to be accepted into the phlebotomy course. And this Enrollment agreement must be signed.
Each student will receive a copy of the current enrollment agreement and catalog with its volume and date.

Refund Policy: If a student cannot be accepted by the school the student will receive a full refund. Each student will have a 72 hour cooling off period in which the student that Enrolls will have three business days to receive a full refund. A three-business-day cooling-off period, commencing with the day an enrollment agreement with the applicant is signed and an initial deposit or payment toward tuition and fees of the institution is made until midnight of the third business day following such date or from the date that the student first visits the institution, whichever is later.

Students, who withdraw after three (3) business days, but before commencement of classes, are entitled to a full refund of all tuition and fees paid except the cancellation charge of 25% of course price (Phlebotomy course $148.75) (IV course $98.75). (EKG Course $73.75: Students will also have the opportunity to reschedule at a future date one time at no cost if they choose not to cancel but need to start at a later scheduled class.

Any credit or previous training given by another party shall not impact the refund policy. Any withdrawals or in-completion of the course on the instructor's or Schools part the student will receive a full refund.
For any student withdrawal/termination refer to the refund formula below.

All refunds will be made within 30 days from the date of termination. The official date of termination or withdrawal of a student shall be determined when The date on which the school receives written notice of

the student’s intention to discontinue the training program; or The date on which the student violates published school policy, which provides for termination.

A student will receive a full refund if education services is discontinued by the school, Except if the school ceases operation.

Refund Formula:
Student is entitled to upon withdrawal/termination

Within first 10% of program (Lesson 1 first day): 90% less cancellation charge

After 10% but within first 25% of program (Lesson 2 Second day): 75% less cancellation charge

After 25% but within first 50% of program (Lessons 3 Third day): 50% less cancellation charge

After 50% but within first 75% of program (Lessons 4 Fourth day): 25% less cancellation charge

After 75% (Lesson 5 Fifth day) No Refund

Student Complaints: Attempting to resolve any issue with the school first is strongly encouraged. Complaints may be filed by a student or guardian at any time online with the Division of Private Occupational Schools (DPOS) within two years from the student’s last date of attendance or at any time prior to the commencement of training at http://highered.colorado.gov/dpos, 303-862-3001.

By signing below, the student agrees to pay Oquirrh Mountain Phlebotomy School LLC the total stated tuition of the program.
The school agrees to provide the occupational training in accordance with the provisions of the school’s
Current Catalog Volume No._1________ Dated___01/01/2023_____ (“Catalog”). Payment of all monies due
shall be a condition of continuing enrollment. Upon satisfactory completion of all academic and skill
requirements and when all financial obligations to the school have been met the school will award the
Certificate to the student.
The student and school understand that this Enrollment Agreement, WHICH INCLUDES THE REFUND POLICY,
may not be amended except in writing and signed by both parties.

System of reporting grades: Both the phlebotomy and IV course is pass or fail. Students will receive a certificate of completion at the end of the course

Postponement of a starting date, Any postponements at the request of Oquirrh Mountain Phlebotomy School or the student, will require a written agreement signed by the student and the school. In this written agreement there will require an explanation on the postponement or reason of the change of the original start date from Oquirrh Mountain Phlebotomy School or the student and a deadline for the new start date.

If the course is not commenced, or the student fails to attend by the new start date set forth in the agreement, the student will be entitled to an appropriate refund of prepaid tuition and fees within 30 days of the deadline in accordance with the school’s refund policy and all applicable laws and rules concerning the Private Occupational Education Act of 1981.

Facilities: The school is located at 3333 S. Bannock St suite B100 Englewood CO 80110. Our classrooms are furnished with tables and chairs. Supplies provided by the school and teaching aids/videos to enhance classroom experience. Bathrooms are on site for students to use. Parking is also available outside the building. Teaching aids that are included: Video, Hands on instruction. Lectures, Applied phlebotomy textbook, Practice fake arms.

When an unexpected closure occurs due to extraordinary conditions such as inclement weather, students will be notified as soon as possible by phone and/or radio, and/or TV who provide closure information as a public service. Classes are not held on the following holidays:

IV Classes are held one day per month.

Enrollment Period:Prospective students may enroll anytime. Late enrollments will be accepted only one week into the course, depending on length of the course.

Placement Assistance: Oquirrh Mountain Phlebotomy school makes no guarantee, expressed or implied, of future employment. Current law prohibits any school from guaranteeing job placement as an inducement to enroll students.

Attendance Policy: Students are expected to arrive on time for class. Students will be required to attend all 5 days of class and complete a study manual before the end date of class. 100% is required. Instructors may request your withdrawal from a course or program if absences or tardiness exceed 90%. Students can make up a class one time at no charge. If a student misses their class that is to be completed they will need to pay another deposit of $100.00 to reschedule. Re-Admittance: Students may continue the program with one year of registration.

Students who are unable to continue classes for medical reasons or severe personal problems will be required to take a leave of absence until they are able to return to class. Proper documentation will be required to substantiate a student’s withdrawal.

Progress Policy: Each student must complete all 5 days with a minimum of 25 successful blood draws and have completed the Theory textbook. Grading system is pass or fail. If you do not complete the progress policy above a student will be unsatisfactory. A student will be on probation if the 5 days of class attendance and the 25 successful blood draws are not complete. Students who are unable to continue classes for medical reasons or severe personal problems will be required to take a leave of absence until they are able to return to class. Proper documentation will be required to substantiate a student’s withdrawal.

Dismissal: Any student may be dismissed for violations of rules.A student also may be withdrawn from classes if he or she does not prepare sufficiently, neglects assignments, or makes unsatisfactory progress. The director, after consultation with all parties involved, makes the final decision. A student's behavior is very important in taking this class if for any reason a student is violent towards another student or the instructor or disruptive in any way and has had three written warnings they will be removed permanently from the program/course and no longer be able to participate in the program.

Re-admission: Students can be readmitted to the IV or Phlebotomy program for any reason except for dismissal violations.

any reason a student is violent towards another student or the instructor or disruptive in any way and has had three

warnings they will be removed permanently from the program/course without refund or their certificate of completion.

Occupational Objective: Oquirrh Mountain Phlebotomy School LLC will help you learn the basics to drawing blood and receive your certificate for employment as a phlebotomist.

Description of each approved educational program:

Phlebotomy Course Occupational Objective: Oquirrh Mountain Phlebotomy School LLC will help you learn the basics to drawing blood and receive your certificate for employment as a phlebotomist.

In the 32 hour phlebotomy program there will be lectures and hands-on phlebotomy procedures practice video’s of phlebotomy field instructions and quizzes. Each student must complete a study manual by the end of the last day at home as part of the hours of completing the phlebotomy program. The grading for this course is either pass or fail. Students will need to have 25 successful blood draws or more by the last day of class. By passing the student will then receive a certificate of completion. If these requirements are successfully met the student will receive his/her certificate of completion.

IV Course Occupational Objective: You will learn the basics in performing IV’s and being confident in your career.

Phlebotomy course Length of Program: 32 hours total. 17 theory hours and 15 lab hours.
IV Course length/hours 4 Hours total 1 theory hour and 3 lab hours. Each course is offered 1 Saturday a month

January- December
Mid afternoon phlebotomy class: Monday through Friday 2:00pm- 5:00pm

Evening Phlebotomy class: Monday through Friday 6:00pm – 9:00pm. Credit Hours: no credit hours are provided.
Method of Delivery: Classroom and Theory

Prerequisites: You must have your High school diploma or a General Education Development certificate and be 18 or older to be accepted into the phlebotomy course. And this Enrollment agreement must be signed.

Previous Training / Credits: Credit will not be given for previous education or experience.
The school does not guarantee the transfer ability of its credits to any other institution unless there is a written agreement with another institution.
